Terms of service

OVERVIEW

Welcome to Barker & Paw.

The terms “we”, “us” and “our” refer to Barker & Paw. We operate this website and online store and provide the information, content, features, products and services available through it (together, the “Services”).

Our online store is hosted and supported by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy and any other policies made available on our website, set out the terms on which you may access and use our Services and purchase products from us.

Please read these Terms carefully before using our website or placing an order.

By accessing or using our Services, you agree to these Terms. If you do not agree to them, you should not use our Services.

Nothing in these Terms affects any statutory rights you may have as a consumer under applicable UK law.

SECTION 1 – ACCESS AND ACCOUNT

You must be at least 18 years old, or otherwise legally capable of entering into a binding contract, to place an order through our website.

You may browse our website without creating an account, although certain features may require you to provide information such as your name, email address, billing address, delivery address and payment details.

You must ensure that any information you provide to us is accurate, complete and up to date.

If you create an account, you are responsible for keeping your login details confidential and for activity carried out through your account.

You must notify us promptly if you believe your account has been accessed or used without your permission.

You must not sell, transfer or allow another person to use your account in a way that breaches these Terms.

SECTION 2 – OUR PRODUCTS

Barker & Paw creates simple, natural and straightforward products designed to support everyday dog care.

Our Daily Dental Powder uses a single natural kelp ingredient and is intended to be sprinkled over a dog’s food in accordance with the directions provided with the product.

We take reasonable care to ensure that product descriptions, photographs, ingredients, quantities and other information displayed on our website are accurate.

However, product packaging, appearance or colours may occasionally differ slightly from photographs displayed on a screen.

We may update product descriptions, packaging or availability from time to time.

All products must be used in accordance with the instructions and information supplied with them.

Information provided on our website about pet care is for general informational purposes and is not intended to replace advice from a qualified veterinary professional. If you have concerns regarding your dog’s health, diet, medication or suitability for a particular product, you should seek appropriate veterinary advice.

Nothing in these Terms excludes your statutory rights in relation to goods that are faulty, not as described or otherwise do not meet the standards required by law.

SECTION 3 – ORDERS AND CONTRACT FORMATION

When you place an order through our website, you are making an offer to purchase the products in your order.

After you place an order, we may send you an acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.

A binding contract between you and Barker & Paw is formed when we confirm that your order has been accepted or dispatched.

We reserve the right to decline or cancel an order before acceptance where reasonably necessary, including where:

  • a product is unavailable;

  • there is an obvious pricing or description error;

  • payment cannot be authorised;

  • we reasonably suspect fraud or misuse;

  • delivery restrictions apply; or

  • we are unable to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

Please check your order carefully before submitting it. If you wish to change or cancel an order after placing it, contact us as soon as possible. We cannot guarantee that changes can be made once processing or dispatch has started.

Returns, cancellations and refunds are subject to our Refund Policy and your statutory consumer rights.

Our products are intended for personal or household use unless we expressly agree otherwise.

SECTION 4 – PRICES AND PAYMENT

The price payable for a product will be the price displayed on our website when you place your order, subject to correction of any obvious pricing error.

Prices displayed to UK consumers will include VAT where applicable and where required by law.

Any delivery charges or other applicable costs will be shown before you complete your purchase.

We may change our prices, promotions and discounts from time to time. Changes will not normally affect orders that we have already accepted.

You must provide accurate and authorised payment information when placing an order.

By submitting payment details, you confirm that you are authorised to use the payment method provided.

Payment may be processed by Shopify or other authorised third-party payment providers.

If a payment is declined, reversed or otherwise unsuccessful, we may decline or cancel the relevant order.

SECTION 5 – SHIPPING AND DELIVERY

Available delivery methods, charges and estimated delivery times will be displayed during checkout where applicable.

Any delivery dates or times stated are estimates unless we expressly agree otherwise.

We will take reasonable steps to deliver your order within the estimated timeframe and, where applicable, within the period required by UK consumer law.

We are not responsible for delays caused by circumstances outside our reasonable control, but we will take reasonable steps to minimise the effect of any such delay.

For consumer orders, responsibility for the goods generally remains with us until they are delivered into your physical possession or the possession of a person identified by you to receive them.

If you independently arrange for a carrier that was not offered by us as a delivery option, different rules regarding risk may apply.

Please ensure that the delivery information provided when placing your order is correct. We are not responsible for delays or failed deliveries caused by materially incorrect information supplied by you, although we will make reasonable efforts to assist where possible.

SECTION 6 – INTELLECTUAL PROPERTY

The content available through our Services, including our branding, trade marks, logos, text, photographs, graphics, videos, designs, layouts and other materials, is owned by or licensed to Barker & Paw, Shopify or the relevant rights holder and is protected by applicable intellectual property laws.

You may access and use our website for your personal and non-commercial use.

Unless permitted by law or with our prior written consent, you must not reproduce, copy, distribute, modify, publish, commercially exploit or create derivative works from our website content.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

“Barker & Paw” and any associated logos, product names, designs or branding belonging to us must not be used without our prior written permission.

Shopify and any other third-party names, trade marks or logos appearing through the Services remain the property of their respective owners.

SECTION 7 – OPTIONAL AND THIRD-PARTY TOOLS

We may make third-party tools, services or functionality available through our website.

These services may be operated independently from Barker & Paw and may be subject to separate terms and privacy policies.

We do not control third-party services and cannot guarantee that they will always be available, uninterrupted or free from errors.

Your use of third-party tools is subject to any terms applicable to those services.

Nothing in this section limits liability that cannot lawfully be excluded.

SECTION 8 – THIRD-PARTY WEBSITES AND CONTENT

Our website may contain links to websites, services or content operated by third parties.

We provide such links for convenience or informational purposes and do not necessarily endorse or control the relevant third party.

We are not responsible for the content, availability, security or practices of third-party websites.

If you choose to visit a third-party website or purchase goods or services from another business, your relationship with that third party will be governed by its own terms and policies.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify, which provides the technology and e-commerce infrastructure that enables us to operate the Services.

Purchases made through our store are made directly between you and Barker & Paw.

Except where Shopify separately provides a service directly to you, Barker & Paw remains responsible for the products sold through our store and for our obligations to you as the retailer.

Shopify may process information in connection with operating and providing the e-commerce platform. Further information about how personal information is handled is available through our Privacy Policy and Shopify’s own privacy information.

Nothing in this section excludes any rights or remedies that you may have under applicable law.

SECTION 10 – PRIVACY AND PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy and applicable UK data protection legislation.

Our Privacy Policy explains the categories of personal information we collect, why we collect it, how we use it, who it may be shared with, how long it may be retained and the rights available to you.

Because our store is hosted using Shopify, personal information may also be processed by Shopify and authorised service providers in order to operate our store, process transactions, provide technical services and support our business.

Where personal information is transferred outside the United Kingdom, appropriate safeguards will be used where required under applicable UK data protection law.

Please review our Privacy Policy for further information.

SECTION 11 – REVIEWS, COMMENTS AND FEEDBACK

If you voluntarily submit reviews, comments, photographs, suggestions, ideas or other content to us (“Feedback”), you confirm that you have the right to provide that content.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt and display Feedback for purposes connected with operating, improving and promoting Barker & Paw and our products.

You retain ownership of any intellectual property rights you hold in your Feedback.

You must not submit content that:

  • infringes another person’s intellectual property or privacy rights;

  • is false or misleading;

  • is defamatory, threatening, discriminatory or unlawful;

  • contains malicious software or harmful code; or

  • impersonates another person.

We may remove Feedback where we reasonably believe it breaches these Terms or applicable law.

Nothing in this section affects your legal rights in relation to how we use your personal information.

SECTION 12 – ERRORS AND INACCURACIES

We take reasonable care to keep information on our website accurate and up to date.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, prices, promotions, delivery charges, availability or estimated delivery times.

We may correct obvious errors or update information where reasonably necessary.

If an error affects an order you have already placed, we will contact you where appropriate and explain the available options.

Nothing in this section allows us to remove or restrict rights you have under consumer law.

SECTION 13 – PROHIBITED USES

You must use our Services only for lawful purposes.

You must not use our website or Services:

  • for unlawful, fraudulent or malicious purposes;

  • to infringe our intellectual property rights or those of another person;

  • to harass, threaten, abuse or unlawfully discriminate against another person;

  • to submit deliberately false or misleading information;

  • to transmit viruses, malware or other harmful code;

  • to send spam or unauthorised advertising;

  • to impersonate another individual or organisation;

  • to obtain unauthorised access to our systems;

  • to interfere with the security or operation of our Services;

  • to collect personal information about other users unlawfully;

  • to circumvent technical security or access restrictions; or

  • to scrape, extract or systematically copy substantial parts of our website without permission where such activity is not otherwise permitted by law.

We may suspend or restrict access to our Services where we reasonably believe these Terms have been breached.

SECTION 14 – AUTOMATED SYSTEMS AND AGENTS

Automated software, bots, artificial intelligence agents or similar systems must not access or interact with our Services in a way that:

  • conceals or misrepresents the automated nature of the interaction;

  • attempts to circumvent security measures;

  • interferes with the operation or availability of our Services;

  • accesses information without authorisation;

  • breaches these Terms or applicable law; or

  • places an unreasonable technical burden on our systems.

We may use reasonable technical measures to prevent or restrict automated access where necessary to protect our website, customers or Services.

This section does not prohibit lawful uses that we have expressly authorised or that cannot legally be restricted.

SECTION 15 – SUSPENSION AND TERMINATION

We may suspend or terminate access to an account or to parts of our Services where reasonably necessary, including where we believe:

  • these Terms have been materially breached;

  • our Services are being used unlawfully or fraudulently;

  • there is a security risk; or

  • suspension is necessary to protect our business, customers or systems.

Termination or suspension of website access will not remove any rights or obligations relating to an order or contract that already exists.

Any provisions that are intended by their nature to continue after termination will remain in effect.

SECTION 16 – PRODUCT AND SERVICE WARRANTIES

We do not guarantee that our website will always be available, uninterrupted or completely free from technical errors.

We may temporarily suspend or restrict access to our website for maintenance, security, operational or technical reasons.

However, nothing in these Terms excludes or restricts any statutory rights that apply to products purchased from us.

Where you are a consumer, goods supplied by us must meet the standards required by applicable consumer law, including requirements relating to satisfactory quality, fitness for purpose and conformity with their description.

Nothing on our website constitutes a guarantee of a particular health or veterinary outcome unless we expressly state otherwise and are legally entitled to make such a guarantee.

SECTION 17 – LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • liability arising from defective products where such liability cannot lawfully be excluded;

  • breach of your statutory consumer rights; or

  • any other liability that cannot be excluded or limited under applicable law.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed.

Our products and Services are supplied for personal and household use unless otherwise agreed. If you use them for commercial or business purposes, we will not normally be responsible for business losses such as loss of profit, revenue, opportunity or business interruption, to the extent permitted by law.

Nothing in this section affects your statutory consumer rights.

SECTION 18 – YOUR RESPONSIBILITIES

You are responsible for using our products in accordance with their packaging, instructions and intended purpose.

You are also responsible for providing accurate information when placing an order and for using our website lawfully.

You will remain responsible for any liability imposed on you by law as a result of your own unlawful conduct or infringement of another person’s rights.

Nothing in these Terms requires a consumer to compensate or indemnify us for losses beyond those for which the consumer is legally responsible.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

If we delay exercising or enforcing a right under these Terms, this does not mean that we have waived that right.

These Terms, together with our Privacy Policy, Refund Policy and any other terms expressly applying to your order, form the agreement between you and Barker & Paw relating to your use of our Services and purchase of our products.

Nothing in these Terms limits liability for fraudulent statements or misrepresentations that cannot legally be excluded.

SECTION 21 – TRANSFER OF RIGHTS

You may not transfer your rights or obligations under these Terms to another person without our written agreement, except where the law allows you to do so.

We may transfer our rights or obligations under these Terms to another organisation, for example as part of a business restructuring or transfer, provided that doing so does not reduce your rights under these Terms or applicable law.

Where required, we will notify you of such a transfer.

SECTION 22 – GOVERNING LAW AND JURISDICTION

These Terms and any contract between you and Barker & Paw are governed by the laws of England and Wales.

If you are a consumer living in England or Wales, the courts of England and Wales will have jurisdiction over disputes relating to these Terms or your purchase.

If you are a consumer resident elsewhere in the United Kingdom, you may also have the right to bring proceedings in the courts of the part of the United Kingdom in which you live.

If you are purchasing from outside the United Kingdom, mandatory consumer protection laws in your country of residence may also apply where they cannot lawfully be excluded.

SECTION 23 – HEADINGS

Section headings are included for convenience only and do not affect the interpretation of these Terms.

SECTION 24 – CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements.

The current version will be made available on our website.

Changes will not normally affect orders that were accepted before the updated Terms came into effect unless required by law.

Where a change materially affects your rights in relation to an ongoing Service, we will provide notice where required by applicable law.

Your continued use of our website after updated Terms become effective will constitute acceptance of the updated Terms in relation to future use of the Services.
